NOTE: The Nuclear-Free Zone Model Resolution is modeled after the Nuclear Free Zone Ordinance (Section 12.90.070 of the Nuclear Free Berkeley Act (Berkeley. Municipal Code Ch. 12.90; Ordinance No. 5784-N.S.)), enacted by the City of Berkeley, CA, USA. The Nuclear-Free Zone Model Resolution (below) extends the prohibition beyond nuclear weapons to encompass Depleted Uranium (DU) munitions and weapons; nuclear power plants (which by the evidence as as a low-level nuclear war on the surrounding civilian population); and other nuclear technologies and nuclear waste; and banning Uranium mining (where applicable). NUCLEAR FREE ZONE – MODEL RESOLUTION
1.0 Title: This Resolution shall be named the ______________________________ (Name of City; municipality; county; province; prefecture; state; nation, etc.) Nuclear-Free Zone Resolution.
2.0 Purpose: The Purpose of this Nuclear-free Zone Resolution is to
protect the public health and the health of the environment of
________________________________

county; province; prefecture; state; nation, etc.) from the negative
impacts caused by nuclear technologies, including but not limited to
nuclear weapons and nuclear weapons testing, nuclear power and nuclear
reactors, and depleted uranium, and uranium mining, which produce permanent, pernicious
radioactive poisons which act globally.
3.0 Findings: The negative impacts of radiation from nuclear weapons and nuclear weapons testing, nuclear power and nuclear reactors, and depleted uranium weaponry, and uranium mining, include but are not limited to the following.

3.2 Birth defects
3.3 Chronic diseases caused by neurological and neuromuscular radiation damage
3.4 Mitochondrial diseases (Chronic fatigue syndrome, Lou Gehrig’s, Parkinsons nad Alzheimer’s; Heart and brain disorders)
3.5 Global DNA damage in men’s sperm; Infertility in women.
3.6 Learning disabilities
3.7 Mental illness -
3.8 Birth rates & death rates
3.9 Diabetes
3.10 Infant mortality and low birth weights
3.11 Atmospheric testing impact on Environment
3.12 It is hereby found that the only feasible remedy to cease the damage to the environment and public health caused by ionizing radiation, and to safeguard the future of humanity and all living things, is to permanently abolish all nuclear technologies.
4.0 Nuclear-Free Zone: ________________________________

5.0 PROHIBITIONS
5.1 Nuclear weapons – Any research, design, development,
production, testing, transport, storage, placement, sale, use or
deployment of any and all nuclear weapons is hereby permanently
prohibited within the territorial limits, waters and airspace of
________________________________ (Name of City; municipality; county; province; prefecture; state; nation, etc.)
5.2 Nuclear power plants, nuclear reactors, nuclear reprocessing
plants - Any research, design, development, production, testing,
transport, storage, placement, sale, use or deployment of any and all
nuclear power plants, nuclear reactors (whether land-based, air-based,
sea-based, or space-based), or nuclear re-processing plants is hereby
permanently prohibited within the territorial limits, waters and
airspace of
________________________________ (Name of City; municipality; county; province; prefecture; state; nation, etc.).
5.3 Depleted Uranium - Any research, design, mining, production,
testing, transport, storage, placement, sale, use or deployment of
depleted uranium and/or any research, design, production, testing,
transport, storage, placement, sale, use or deployment of any military
or civilian munitions, vehicles, aircraft, missiles, or any other
devices containing any amount of depleted uranium, is hereby
permanently prohibited within the territorial limits, waters and
airspace of

5.4 Nuclear technologies – Any research, design, production,
testing, transport, storage, placement, sale or deployment of any other
nuclear technology that uses nuclear energy is hereby permanently
prohibited within the territorial limits, waters and airspace of
________________________________ (Name of City; municipality; county; province; prefecture; state; nation, etc.)
5.5 Nuclear waste - The production, testing, transport, storage,
placement, sale, use or deployment of any and all nuclear waste is
hereby permanently prohibited within the territorial limits, waters and
airspace of
________________________________ (Name of City; municipality; county; province; prefecture; state; nation, etc.).
5.6 Uranium exploration and mining - The exploration and mining of
Uranium is hereby permanently prohibited within the territorial limits,
waters and
airspace of
________________________________ (Name of City; municipality; county; province; prefecture; state; nation, etc.).
6.0 Definitions
6.1.1 "Nuclear weapon" is any device, the intended explosion of which results from the energy released by reactions involving atomic nuclei, either fission or fusion, or both. This definition of nuclear weapons includes the means of transporting, guiding, propelling or triggering the weapon if and only if such means is destroyed or rendered useless in the normal propelling, triggering, or detonation of the weapon.
6.1.2 "Component of a nuclear weapon" is any device, radioactive or non-radioactive, the primary intended function of which is to contribute to the operation of a nuclear weapon (or be a part of a nuclear weapon).
6.2.1 "Nuclear reactor" is any device, the purpose of which is to release energy from non-explosive reactions involving the fission of atomic nuclei.
6.2.2 “Nuclear power plant is any device for the production of electricity utilizing a nuclear reactor or through technologies utilizing nuclear fuel.
6.3 “Nuclear waste” is any by-product of nuclear weapons or nuclear fuel cycles.
6.4 Nuclear fuel cycle is the mining, enrichment, transport, reprocessing and/or storage of nuclear waste.
6.5 Nuclear technology is any technology that utilizes nuclear energy, including but not limited to nuclear weapons, nuclear reactors, and/or depleted uranium.
7.0 ENFORCEMENT
7.1 Any person or employee, contractor, officer, director, or other agent
of
any civilian or military governmental entity, corporation, university,
laboratory, institution, non-governmental organization, partnership or
other entity who violates any provision of this Resolution, including
but not limited to Article 5.0 of this Resolution shall be punished by:
(a) Up to _______ years imprisonment for each violation of this Resolution; and
(b) A fine of ____________/day for each continuing violation of this Resolution.
7.2 Residents of ________________________________ (Name of City;
municipality;
county; province; prefecture; state; nation, etc.) shall also have the
right to enforce this act by appropriate civil actions for declaratory
or injunctive relief. Reasonable attorney's fees and court costs shall
